Terms of Service

1. About Us

These terms govern your use of the website design, hosting, and related services provided by Use Signal Marketing Ltd (company number 16564879), registered at Unit 13 Freeland Park, Wareham Road, Lytchett Matravers, Poole, England, BH16 6FA. References to "we", "us", or "our" mean Use Signal Marketing Ltd. References to "you" or "your" mean the customer.

2. The Service

We provide website design, development, hosting, and related digital services to UK businesses. Our "free website" service includes a professionally designed website at no upfront cost, subject to a recurring monthly hosting fee. The website design itself is provided free of charge. The monthly hosting fee covers hosting, maintenance, security monitoring, and ongoing support.

3. Monthly Hosting Fee

The monthly hosting fee is charged on a recurring basis via the payment method you provide at checkout. The current fee is displayed at the point of purchase and may be subject to change with 30 days' written notice. Payment is collected automatically each month. If payment fails, we will make reasonable attempts to collect. Continued failure to pay may result in suspension or termination of your website.

4. Website Ownership

We retain full ownership of the website design, code, and all associated assets for a minimum period of 12 months from the date of activation. During this period, the website remains our intellectual property and is licensed to you for use solely in connection with your active hosting subscription.

After 12 consecutive months of uninterrupted paid service, ownership of the website design may be transferred to you upon written request. This transfer is at our discretion and subject to all outstanding payments being settled. Domain names registered on your behalf are held by us during the 12-month period and may be transferred to you upon completion of this period, subject to the same conditions.

If you cancel your subscription before completing 12 months of service, you do not retain any rights to the website design, code, content created by us, or the domain name.

5. Cancellation

You may cancel your subscription at any time by contacting us. Cancellation takes effect at the end of your current billing period. Upon cancellation:

• Your website will be taken offline at the end of the paid period.
• You will not receive a refund for the current or any previous billing period.
• If you have not completed 12 months of service, you do not retain ownership of the website or domain.
• We may, at our sole discretion, provide you with a copy of your website content upon request.
• Your data will be retained for 30 days after cancellation, after which it may be permanently deleted.

6. Refunds

All payments for our digital services are non-refundable. This includes the monthly hosting fee, any add-on services (such as expedited build), and any one-off charges. As a digital service that is delivered immediately or near-immediately upon payment, you acknowledge that you are waiving your right to a 14-day cooling-off period under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

If you believe there has been an error with your payment or are dissatisfied with the service, please contact us at team@signal.marketing and we will review your case on an individual basis.

7. Add-On Services

We may offer additional services including but not limited to: expedited website builds, logo design, professional email setup, and premium features. All add-on services are non-refundable once work has commenced or the service has been delivered. Pricing for add-on services is displayed at the point of purchase.

8. Custom Projects

For bespoke website design and development projects priced individually (outside of the free website service), payment is typically structured in milestones. Once a milestone payment has been made and work on that milestone has commenced, that payment is non-refundable. We will provide a clear scope of work and payment schedule before any custom project begins.

9. Use of Automated Tools

We may use automated tools, including artificial intelligence, to assist with the creation of website content, design elements, and other aspects of the service. All AI-generated content is reviewed and may be edited before being published on your website. You acknowledge and agree to the use of such tools as part of the service delivery process.

10. Your Responsibilities

You agree to:

• Provide accurate and complete information during signup and onboarding.
• Ensure that any content you provide (text, images, logos) does not infringe any third-party rights.
• Not use your website for any unlawful purpose or to distribute harmful, offensive, or misleading content.
• Keep your login credentials secure and notify us immediately of any unauthorised access.
• Maintain a valid payment method on file for the duration of your subscription.

11. Hosting and Uptime

We host all websites on UK-based servers and aim to provide a minimum of 97% uptime. This excludes scheduled maintenance (of which we will provide reasonable notice) and any downtime caused by factors outside our control, including but not limited to: your own actions or modifications to the website, third-party service outages, force majeure events, or DNS propagation delays.

We actively monitor all hosted websites for malware and security threats. In the event of a security incident caused by a vulnerability in our hosting infrastructure, we will take reasonable steps to resolve the issue at no additional cost.

12. Limitation of Liability

To the maximum extent permitted by law, Use Signal Marketing Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the service.

Our total liability for any claim arising from or related to the service shall not exceed the total amount you have paid to us in the 3 months immediately preceding the claim.

13. Intellectual Property

All intellectual property rights in the website design, code, templates, themes, plugins, and tools used to build your website remain the property of Use Signal Marketing Ltd unless and until ownership is transferred in accordance with Section 4 of these terms. Content you provide to us (your business information, logos, photographs) remains your property.

14. Termination by Us

We reserve the right to suspend or terminate your service immediately if you breach any of these terms, fail to pay your hosting fee after reasonable reminders, use the service for unlawful purposes, or engage in conduct that may bring our company into disrepute. In such cases, no refund will be provided.

15. Changes to These Terms

We may update these terms from time to time. If we make material changes, we will notify you by email at least 14 days before the changes take effect. Your continued use of the service after changes take effect constitutes acceptance of the updated terms.

16. Governing Law

These terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the English courts.
